  • Service refers to the Application or the Website or both.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • First name and last name
  • Phone number
  • Address, State, Province, ZIP/Postal code, City

Usage Data is collected automatically when using the Service.


Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.


When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.


We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.


Information Collected while Using the Application


While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:


  • Location, including in the background. Where You have granted permission, the Application collects Your device location while You are signed in, including while the Application is running in the background. Location is used to show Your position on the job map, to route and dispatch work, and to record arrival at and completion of job sites. It is sent only to Marine Pro Systems' own servers. It is never used for advertising, never combined with data obtained from other companies, and never sold or shared with data brokers.
  • Camera and photo library. Photographs You capture or select in order to document equipment, job sites and completed work.


We use this information only to operate the features described above. The information may be uploaded to the Company's servers, or it may simply be stored on Your device.


You can enable or disable location and photo access at any time through Your device settings. The Application does not require tracking permission and does not access Your contacts.


A note for field crews


Where Your employer uses the Application to dispatch work, Your location while signed in is visible to administrators and dispatchers within Your employer's organization, and is retained as part of the job record. It is collected for dispatch, routing and job verification. It is not used to evaluate You outside of that purpose, and it is not shared outside Your employer's organization except with the service providers named below.


You can enable or disable access to this information at any time, through Your Device settings.


Cookies


This section applies to the Website only. The mobile Application does not use cookies, advertising identifiers or cross-site tracking technologies of any kind. Cookies are used on the Website to keep You signed in and to remember Your preferences. They are not used for advertising, and We do not use them to track You across other companies' apps or websites. The technologies We use may include:


  • Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of our Service. Unless you have adjusted Your browser setting so that it will refuse Cookies, our Service may use Cookies.
  • Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).


Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on Your personal computer or mobile device when You go offline, while Session Cookies are deleted as soon as You close Your web browser.

  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • To keep the Service reliable: To diagnose crashes and errors, monitor availability and performance, and improve the stability of the Service.


We may share Your personal information in the following situations:


  • With Service Providers: We share information with the service providers named in the "Service Providers" section below, strictly so that they can perform the function We engage them for. They act on Our instructions and may not use the information for their own purposes.
  • Within Your organization: Where Your employer or the account holder uses the Service, Your work records — including job assignments, submitted photographs and location recorded while signed in — are visible to administrators and dispatchers within that organization.
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • For legal reasons: As described under "Disclosure of Your Personal Data" below.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.


What We do not do


To state this plainly, because it is the part people most want to know:


  • We do not sell Your personal information, and We do not share it with data brokers.
  • We do not use Your information for targeted advertising or advertising measurement, and We do not share it with advertising networks.
  • We do not combine Your information with data obtained from other companies to build a profile of You.
  • We do not track You across other companies' apps or websites. The Application contains no advertising SDKs and does not request the iOS App Tracking Transparency permission.
  • We do not access Your contacts or phone book.


Retention of Your Personal Data


We retain personal data only for as long as it is needed for the purposes described in this Policy, or for as long as We are required to keep it by law.


  • Account details (name, email, phone) are retained for as long as the account is active, and are deleted on request as described below.
  • Job records, including location recorded at job sites and submitted photographs, are the record of work performed for a customer and form part of that customer's service history. We retain them for the duration of the customer's contract. They are deleted when the contract ends, or earlier on request as described below, except where We are required to keep them by law.
  • Crash and error reports sent to Sentry are retained according to Sentry's standard retention for our plan, after which they are deleted automatically.
  • Communication data processed through Twilio, such as SMS or voice metadata, is retained as long as necessary to provide the service and comply with applicable laws.


Your Rights and How to Exercise Them


You may ask Us to:


  • tell You what personal data We hold about You, and provide a copy of it;
  • correct personal data that is inaccurate;
  • delete Your personal data; or
  • stop sending You communications.


Email support@marineprosystems.us from the address associated with Your account and We will respond within 30 days. Accounts for the Application are created and administered by Your employer or the account holder rather than in the app itself, so where Your account belongs to an organization We may need to direct Your request to that organization's administrator, and We will tell You if that is the case. Some records must be retained where the law requires it, or where they form part of a customer's service history; where We cannot delete something, We will explain why.


Transfer of Your Personal Data


Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.


Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.


The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

The Service uses Google Maps to display job locations and routes, and Google Places to look up and validate addresses. Requests to these services transmit map and address queries, and — when You are viewing the map — Your approximate position, to Google. Functional Software, Inc. (Sentry) — crash and error reporting


The Application and Website report crashes and errors to Sentry so that We can diagnose and fix them. A report may include the type of device and operating system, the IP address the report was sent from, the sequence of screens visited immediately before the error, and technical diagnostic data. Twilio Inc. — messaging


We use Twilio Inc. to provide messaging and communication services. Twilio processes data such as Your phone number, message contents, timestamps, and delivery status. Twilio's Privacy Policy: https://www.twilio.com/legal/privacy


Amazon Web Services, Inc. — hosting


The Service and its data are hosted on Amazon Web Services infrastructure in the United States. AWS Privacy Notice: https://aws.amazon.com/privacy/


None of these providers is permitted to use Your information for their own advertising, and none of them receives it for that purpose.


Your Responsibilities

Children's Privacy


Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.


If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.
